B. Contractual Precedence

Notwithstanding the above, for any Personal Data processed as "Customer Data" on behalf of our enterprise clients, the retention and deletion periods are governed by the specific terms of the Master Services Agreement (MSA) or Data Processing Agreement (DPA) between Actonia and the client.

6. How We Share and "Share" Information

We do not sell your personal information. We share data with:

  • Service Providers: Third parties that perform functions on our behalf (e.g., HubSpot, ZoHo, Intercom, IBM).
  • Advertising & Analytics Partners: Under the CPRA, we may "share" certain online identifiers (such as cookies, IP addresses, and browsing activity) with third-party advertising partners like Google Analytics or HubSpot to provide cross-context behavioral advertising and analyze site performance. You may opt-out of this sharing as described in Section 9.
  • Affiliates: Our parent company or subsidiaries for purposes consistent with this policy.
  • Legal Compliance: When required by warrants, subpoenas, or court orders.
  • Business Transfers: In the event of a merger, acquisition, or sale of assets.

7. International Data Transfers

Personal Data may be transferred to, and processed in, the United States. To ensure an adequate level of protection, we utilize:

California-Specific Rights (CCPA/CPRA)

  • Right to Opt-Out of Sharing: You can opt-out of cross-context behavioral advertising (as defined in Section 6) by emailing privacy@seoclarity.net with the subject line "Opt-Out of Sharing."
  • California "Shine the Light": California Civil Code Section 1798.83 permits users who are California residents to request certain information regarding our disclosure of Personal Data to third parties for their direct marketing purposes.
